RentCafe Terms of Service
By using RentCafe.com (RentCafe ILS) or any property websites powered by RentCafe (RentCafe Portal) (collectively, "RentCafe"), you accept and agree to be bound by the latest version of the RentCafe Terms of Service (posted at https://resources.yardi.com/legal/rentcafe-terms-of-service/ ), which are between you and RentCafe (not the property) and will be updated from time to time. The property may have its own terms and conditions that apply between the property and you.1. Lease Contract Information. The Lease Contract contemplated by the parties is attached--or, if no Lease Contract is attached, the Lease Contract will be the current NAA Lease Contract.
2. Application Fee (non-refundable) and Administrative Fee. You have delivered to our representative an application fee in the amount of $75 per applicant, and this payment defrays the cost of the credit and criminal background screening, the verification of income, and rental history for application processing. It is nonrefundable. You have delivered to our representative an administrative fee in the amount of $75 per applicant, and this payment partially defrays the cost of lease paperwork preparation in addition to the above-mentioned application. This fee is refundable if the applicant cancels, or the application is denied. An additional non-refundable fee of $30 will be charged for background checks on all "occupant only" applicants over the age of 18.
3. Security Deposit and Redecoration Fee (may or may not be refundable). In addition to any application fee, you have delivered to our representative a security deposit and redecoration fee in the amounts indicated. The deposit/fee is required to hold the apartment you have chosen. The deposit/fee will be refunded under paragraph 10 if your application is not approved; OR it will be retained by us as liquidated damages if you fail to sign or attempt to withdraw under paragraph 6 or 7.
4. Approval When Lease Contract Is Signed in Advance. If you and all co-applicants have already signed the Lease Contract when we approve the Application, our representative will notify you (or one of you if there are co-applicants) of our approval and sign and execute the Lease Contract.
5. Approval When Lease Contract Is Not Yet Signed. If you and all co-applicants have not signed the Lease Contract when we approve the Application, our representative will notify you (or one of you if there are co-applicants) of the approval, prepare the Lease Contract, and sign and execute the Lease Contract when you and all co-applicants have signed.
6. If You Fail to Sign Lease Contract After Approval. Unless we authorize otherwise in writing, you and all co-applicants must sign the Lease Contract prior to taking possession of the unit. If you or any co-applicant fails to sign as required, we may keep the security deposit and redecoration fee as liquidated damages, and terminate all further obligations under this Agreement.
7. If You Withdraw After Approval. If it has surpassed 24 hours since the approval of your Application and you or any co-applicant withdraws an Application or notifies us that you have changed your mind about renting the dwelling unit, we will be entitled to retain all security deposits and redecoration fees as liquidated damages, and the parties will then have no further obligation to each other.
8. Completed Application. An Application will not be considered complete and will not be processed until all the following have been provided to us. (1) a separate Application has been fully filled out and signed by you and each co-applicant (2) an application fee has been paid to us per applicant (3) a security deposit and redecoration fee have been paid to us (4) an administrative fee has been paid to us per applicant.
9. Non-approval in Seven Days. We will notify you whether your application has been approved within seven days after the date we receive a completed Application. Your Application will be considered disapproved if we fail to notify you of approval within seven days after we have received a completed Application. Notification may be in person or by mail or telephone unless you have requested that notification be by mail. You must not assume approval until you receive actual notice of approval.
10. Refund After Non-approval. If your application or any co-application is disapproved or deemed disapproved under paragraph 9, we will refund all security deposits, redecoration fees, and administrative fees within 30 days of such disapproval. Refund checks may be made payable to all co-applicants and mailed to one applicant.
11. Extension of Deadlines. If the deadline for signing, approving, or refunding under paragraphs 6, 9, or 10 falls on a Saturday, Sunday, or a state or federal holiday, the deadline will be extended to the end of the next day.
12. Notice to or from Co-applicants. Any notice we give you or your co-applicant is considered notice to all co-applicants; and any notice from you or your co-applicant is considered notice from all co-applicants.
13. Keys or Access Devices. We will furnish keys and/or access devices only after: (1) all parties have signed the contemplated Lease Contract and other rental documents; and (2) all applicable rents and security deposits have been paid in full.

Certain types of information, including geolocation, device type, onsite website usage and behavior, demographic data, and purchase history, is collected and aggregated across Case & Associates Site users for our analysis and advertising efforts.
Case & Associates uses Remarketing with Google Analytics and Google Adwords to display relevant advertisements to users who have previously visited our Site. Referred to as remarketing or retargeting, Case & Associates may utilize previous session information to serve display advertisements to you on the Site and based on such session information Google may set a cookie and serve ads to you on third party websites on the Google Display Network. Third party vendors such as Google may display Case & Associates ads on websites across the Internet. Aggregated user data may be utilized to create remarketing/retargeting “lists,” or groups of users with similar onsite behaviors or demographics.
Case & Associates also uses Google Display Network Impression Reporting and Google Analytics Demographics and Interest Reporting and Interest-Based Advertising to display advertisements to users based on their inferred interests and demographics. Case & Associates does not run interest-based advertising campaigns that collect personally identifiable information.
